The Farm Creative/Productions, Inc. v Job 1 Systems, Inc.
Using the Uniform Domain Name Dispute Resolution Policy (the "UDRP"), we caused transfer of thefarm.com from a service mark infringer to the rightful owner, The Farm, a creative multimedia production company. In a UDRP action, an arbitrator will transfer a domain name when a legitimate trademark (or service mark) holder proves that (1) an entity has registered a domain name that is identical to, or confusingly similar to, its mark, (2) the entity has no right or legitimate interest in the domain name, and (3) the domain name was registered and being used (or not used) in bad faith. The UDRP offers a cheaper and speedier means of domain name dispute resolution than either traditional trademark litigation or the closely related Anticybersquatting Consumer Protection Act.
